OSCILLATOR Privacy Policy

OSCILLATOR's policies and procedures for handling customer information have been created with the understanding that Internet technologies are constantly evolving and that Internet business methods must also constantly evolve to meet the necessities and opportunities of the changing technologies.

As a result, OSCILLATOR's policies and procedures are subject to change.

In the course of serving its customers, OSCILLATOR acquires, stores and transmits customer communications and information that customers may regard as private or sensitive. Some of this information - such as the customer's name, address, telephone number, and credit card data - is provided to OSCILLATOR by its customers in order to establish service. Other information - such as the customer's account status, choice of services, and customer logs - is created and maintained by OSCILLATOR in the normal course of providing service. OSCILLATOR also uses cookies, which are small pieces of information that a web site can store in a designated file on a user's computer for various reasons.

In addition, OSCILLATOR may store customers' electronic mail (email) and other communications, not only as a necessary incident to the transmission and delivery of those communications, but also as a process for archival.

Archives of communications are kept for the following purposes:

  1. To aid in any investigations by Australian; police, courts of law, military, royal commissions, or federal security services. For OSCILLATOR to provide copies of communications as requested by any of the entities listed above, a warrant or similar notice as recognised in Australia to be authentic and authoritive, must be presented in such a way that OSCILLATOR can obtain and keep a copy for future reference. OSCILLATOR reserves the right to provide information to international organisations that have the authority to uphold laws within their jurisdiction.
  2. To allow an artificially intelligent computer program to compare SPAM and other unwanted communications, as specified by recipients, against legitimate and lawfully acceptable communications. This computer program does not keep a copy of emails for itself, the sole purpose of the program is to build a set of rules, which help to prevent unwanted communications.
  3. To forward to the customer/owner of the original communications. As communications generally have more than one owner, only communications sent from and delivered to a specific individual who holds an account with OSCILLATOR can be supplied to that specific individual. Exceptions may be made, where the entity that owns the service, as hosted by OSCILLATOR, will be granted rights to archived communications belonging to any of the accounts that exist as a part of the entities service. Such a right will only be granted in accordance to privacy laws in Australia.

Archives of these communications can be accessed soley by the owner of OSCILLATOR. The owner of OSCILLATOR will only access such communications by request of the owner of such communications.

It is a condition of use and a condition of the extraction and supply of archived communications, that users of the services hosted by OSCILLATOR will not hold OSCILLATOR or the owner of OSCILLATOR responsible or liable for any damages or infringements caused by the extraction of archived or logged information.

Data Security

OSCILLATOR will protect the confidentiality of its customers' information, account information and personal communications to the fullest extent possible and consistent with the law and the legitimate interests of OSCILLATOR, its partners, its employees and other customers of OSCILLATOR's services. To protect the loss, misuse, and alteration of information that is collected from customers, OSCILLATOR has appropriate physical, electronic, and managerial procedures in place.

Disclosure of customer information and communications

OSCILLATOR will not otherwise disclose its customers' personal and account information unless OSCILLATOR has reason to believe that disclosing such information is necessary to identify, make contact with, or bring legal action against someone who may be causing harm or interfering with the rights or property of OSCILLATOR, OSCILLATOR's customers, or others, or where OSCILLATOR has a belief that the law requires such disclosure.

OSCILLATOR also will not, except for reasons stated below, disclose to third parties the contents of any electronic mail or other electronic communications that OSCILLATOR stores or transmits for its customers.

OSCILLATOR disclaims any intention to censor, edit or engage in ongoing review or surveillance of communications stored on or transmitted through its facilities by customers or others. OSCILLATOR will, however, review, delete or block access to communications that may harm OSCILLATOR, its customers or third parties. The grounds on which OSCILLATOR may take such action include, but are not limited to, actual or potential violations of OSCILLATOR's Acceptable Use Policy.
